And how can lawyers use AI?<\/p>\n<p>Below, we\u2019ll introduce you to OpenAI\u2014the artificial intelligence company that developed ChatGPT\u2014along with the notorious chatbot and what its development means for the legal profession.<\/p>\n<h2>What is OpenAI?<\/h2>\n<p><a title=\"OpenAI\" href=\"https:\/\/openai.com\/\">OpenAI<\/a> is an artificial intelligence (AI) research and development company creating \u201chighly autonomous systems that outperform humans at most economically valuable work.\u201d Tools like ChatGPT are free to use\u2014though, on occasion demand may be too high for you to access it.<\/p>\n<h2>What is ChatGPT?<\/h2>\n<p><a title=\"chat.openai.com\" href=\"https:\/\/chat.openai.com\/auth\/login\">ChatGPT<\/a> is an AI-powered chatbot from OpenAI that responds to open-ended text queries with paragraphs of text-written answers. It was trained through reinforcement learning from human feedback. During this process, human AI trainers would converse as a user and an AI assistant, then rank chatbot responses to teach the chatbot how to respond appropriately.<\/p>\n<p>ChatGPT recently released ChatGPT 4o, which understands images, can browse the web, and speaks more languages. This model brings many of the paid capabilities to the free plan, which makes it an excellent opportunity to test out what\u2019s possible without needing to pay.\u00a0If you\u2019re looking for additional capabilities, you can subscribe to ChatGPT Plus for $20 per month. ChatGPT Plus offers priority access even when demand is high, faster response times, and priority access to new features.<\/p>\n<p><a href=\"https:\/\/www.techopedia.com\/chatgpt-5-all-you-need-to-know\"><span style=\"font-weight: 400\">And, anticipation is rising<\/span><\/a><span style=\"font-weight: 400\"> for OpenAI\u2019s upcoming model and the latest version of ChatGPT: ChatGPT-5. While OpenAI has not yet provided a release date, there is speculation that ChatGPT-5 will be released in the summer of 2024.\u00a0<\/span><\/p>\n<h3>How do you use ChatGPT?<\/h3>\n<p>ChatGPT is relatively simple to use\u2014all you have to do is type in your request on the <a title=\"ChatGPT\" href=\"https:\/\/chat.openai.com\/auth\/login\">ChatGPT website<\/a> or the <a title=\"ChatGPT for chrome\" href=\"https:\/\/chrome.google.com\/webstore\/detail\/webchatgpt-chatgpt-with-i\/lpfemeioodjbpieminkklglpmhlngfcn\">WebChatGPT Chrome plugin<\/a>. And if you\u2019re working from your iPhone, you can access ChatGPT via the <a href=\"https:\/\/apps.apple.com\/au\/app\/chatgpt\/id6448311069\">ChatGPT iOS app<\/a>.<\/p>\n<p>For instance, you can ask the tool to write a poem, answer a question in Shakespearean English, or solve complex math problems.<\/p>\n<p>From there, you\u2019ll get a unique, surprisingly accurate answer on the same website.<\/p>\n<h2>How Lawyers Use ChatGPT<\/h2>\n<p>ChatGPT has transitioned from its initial research phase to being deployed in various applications and platforms, advancements and improvements are always ongoing. This leaves legal professionals naturally asking: how can lawyers use ChatGPT?<\/p>\n<p>While AI might not imminently replace lawyers, there\u2019s no doubt that ChatGPT presents opportunities for law firms. From creating legal marketing content to drafting legal documents <a title=\"ChatGPT prompts\" href=\"https:\/\/www.clio.com\/au\/blog\/chatgpt-prompts-for-lawyers\/\">with the right prompts<\/a>, the benefits of automating your <a title=\"Legal content writing\" href=\"https:\/\/www.clio.com\/au\/blog\/legal-writing-tips-for-lawyers\/\">legal writing<\/a> with AI seem endless.<\/p>\n<p>What\u2019s more, law firm\u2019s are already attempting to leverage ChatGPT technology to support legal clients. With these developments, it\u2019s clear that AI has a role to play in the legal system\u2014though what role that is exactly remains to be seen.<\/p>\n\n\t\n\n<h3>Challenges ChatGPT poses for lawyers<\/h3>\n<p>Beyond technical limitations, like using electronic devices in the courtroom, ChatGPT faces additional hurdles in the legal sphere.<\/p>\n<p>For one, this technology is still in development. And, as eerily accurate as its responses may be, ChatGPT is not a human lawyer.<\/p>\n<p>Nor, it\u2019s not always accurate\u2014<a title=\"twitter.com\" href=\"https:\/\/twitter.com\/palmerlaw\/status\/1618637905190359041\">users have reported receiving incorrect information<\/a> from the chatbot-in-training. ChatGPT only has access to information up to early 2022, which is partially responsible for inaccuracies. But competitors that crawl the web in real-time, like <a title=\"Google Bard\" href=\"https:\/\/www.clio.com\/blog\/google-bard-lawyers\/\">Google Bard<\/a>, also risk pulling inaccurate information published online.<\/p>\n<p>Lacking the nuance necessary to create consistently accurate responses, let alone complex legal arguments, it\u2019s safe to say that\u2014at this stage, at least\u2014ChatGPT is not in a position to replace lawyers.<\/p>\n<p>Additionally, a lawyer\u2019s ethical obligations will always take precedence over convenience.<\/p>\n<p>Not only are there ethical considerations in using AI to argue your cases for you, but issues of security, client privacy, and privilege can also arise through the transmission of data between your firm and ChatGPT. As the chatbot stores personal and conversation data, lawyers must familiarise themselves with ChatGPT\u2019s <a title=\"openai.com\" href=\"https:\/\/openai.com\/privacy\/\">Privacy Policy<\/a> and <a title=\"openai.com\" href=\"https:\/\/openai.com\/terms\/\">Terms of Use<\/a> before using the service.<\/p>\n<h3>Embracing technology\u2014responsibly\u2014in your law firm<\/h3>\n<p>While we\u2019ve highlighted some of the ethical hurdles of how lawyers can use ChatGPT in their law firm, we also know that enthusiastic adoption of technology positively affects a law firm\u2019s business performance.
