The Personal Information Protection and Electronic Documents Act (PIPEDA) is federally enforced and applicable nationwide—with the exception of Quebec, British Columbia, and Alberta. In addition to echoing many of the same legal requirements enforced under PIPEDA, Quebec mandates that firms always inform clients when a decision is being made based exclusively on an AI system’s output, explain how the decision-making process works, and actively minimize the processing of personal information by only relying on data that can be deemed necessary for achieving their stated goals. Additionally, all firms processing personal information within AI systems in Quebec are required to appoint a person responsible for overseeing and enforcing privacy policies in accordance with Law 25 compliance obligations. The location of the data processing may also require disclosure if the data is being transferred outside of Quebec.
While the provinces of Alberta and British Columbia have their own provincial privacy statutes (titled the Personal Information Protection Act (PIPA) in both provinces), each largely contains many of the same regulations and mirrors the emphasis on consent, data security, and accountability outlined in PIPEDA.
In addition to the above, it’s important that Canadian lawyers remain up to date on potential federal legislation aimed at imposing wider restrictions on the design and deployment of AI systems.
