The bill was introduced in BC in 2024 to reform how the province regulates legal professionals.<\/p>\n\t\t<\/div>\n\t<\/div>\n<\/div>\n\n<h2><span style=\"font-weight: 400;\">What would change under Bill 21 in BC?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">To be clear, Bill 21 is not yet in force. If it\u2019s implemented, however, it will lead to major changes to the regulation of legal professionals in BC:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A single regulator would be created to license and discipline lawyers, notaries, and paralegals.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Professional standards and codes of conduct would be unified across the three legal professions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The new regulator would be overseen by a 17-member board; only five seats would be reserved for lawyers, and the rest would be for the public.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">One of the most significant implications of Bill 21 is its shift away from traditional self-regulation. Currently, lawyers in BC are regulated by a board of benchers elected by their peers. But under Bill 21, this system would be replaced by a publicly governed board. However, implementation is expected to take between 18 and 24 months. During this transition, current regulators, like the Law Society, will remain in place.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As soon as the bill was announced, the legal community started pushing back. The Law Society <\/span><a href=\"https:\/\/www.lawsociety.bc.ca\/news-and-engagement\/news\/law-society-of-bc-announces-legal-action-to-challenge-legal-professions-act\/\"><span style=\"font-weight: 400;\">declared<\/span><\/a><span style=\"font-weight: 400;\"> it would launch a legal action challenge to the constitutionality of the Legal Professions Act. And they weren\u2019t alone: the <\/span><a href=\"https:\/\/cbabc.org\/home\/\"><span style=\"font-weight: 400;\">BC branch of the Canada Bar Association<\/span><\/a><span style=\"font-weight: 400;\"> argued that the bill was passed in haste and <\/span><a href=\"https:\/\/www.cbabc.org\/news\/message-to-members-legal-professions-act-passed\/#:~:text=Despite%20multiple%20calls%20to%20allow,intervene%20in%20that%20court%20action.\"><span style=\"font-weight: 400;\">warned<\/span><\/a><span style=\"font-weight: 400;\"> that without an injunction or court order, the transition would take approximately 18 months.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.tlabc.org\/\"><span style=\"font-weight: 400;\">Trial Lawyers Association of BC<\/span><\/a><span style=\"font-weight: 400;\"> has also <\/span><a href=\"https:\/\/www.canadianlawyermag.com\/resources\/professional-regulation\/bc-court-to-decide-if-premier-can-be-questioned-in-lawsuit-testing-legal-professions-act\/390712\"><span style=\"font-weight: 400;\">filed a legal challenge<\/span><\/a><span style=\"font-weight: 400;\">. Similar to the Law Society, they believe Bill 21 undermines the independence of the legal profession and was passed without meaningful consultation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although the government has already begun establishing transitional bodies\u2014such as the Transitional Board and the Indigenous Council\u2014ongoing legal challenges could delay or otherwise impact the full implementation of the law.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Bill 21 in BC: The future of legal regulation?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Despite its controversial nature, Bill 21 marks a significant turning point in the regulation of legal professionals in BC. It reflects growing demand for reform, driven by concerns around access to justice, public accountability, and inequities within society. At the same time, it raises critical questions about professional independence, governance, and how to strike the right balance between public oversight and self-regulation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Wherever you stand on these issues, one thing is clear: Bill 21 isn\u2019t just about BC.
