We\u2019ve all heard the stories about <\/span>lawyers citing fake, AI-generated cases in briefs<\/span><\/a> and the consequences arising from their oversight.\u00a0<\/span><\/p>\n

More recently, there\u2019s been concern over <\/span>the consequences facing law firms<\/span><\/a> who signed onto <\/span>Microsoft\u2019s Azure OpenAI Service<\/span><\/a>, which provides access to OpenAI\u2019s AI models via the Azure Cloud. More than a year after signing on, many law firms became aware of a term of use stating that Microsoft was entitled to retain and manually review certain user prompts. While this term of use might not be concerning on its own, for law firms\u2014who may or may not be sharing confidential client information with these models\u2014this term represents a potential breach of client confidentiality requirements.\u00a0<\/span><\/p>\n

These examples are by no means intended to scare lawyers away from AI\u2014rather, they represent some of the potential pitfalls of adopting AI technology that law firms must be aware of to effectively adopt AI while also upholding their professional duties and protecting clients.\u00a0<\/span><\/p>\n

In this blog post, we\u2019ll explore some of the potential legal issues with AI technology\u2014and what law firms can do to overcome them. The SRA’s Risk Outlook report<\/a> underscores AI’s advantages, including enhanced efficiency, cost savings, and improved transparency. AI can automate routine tasks, enabling staff to focus on more complex work and streamline client data collection before initial consultations, thereby reducing expenses.<\/p>\n
