Regardless of where firms stand on AI adoption, it\u2019s time to start thinking critically about the impact of AI on law firm operations and legal services.<\/span><\/p>\n<h3><b>Clients want to work with firms that use AI<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Nearly half of clients would prefer to work with law firms that use AI, which suggests that they see AI as a means of offering better, more efficient legal services than firms not using AI.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This number is likely to increase when we consider how quickly consumer attitudes surrounding AI use have shifted. In the <\/span><a href=\"https:\/\/www.clio.com\/uk\/guides\/legal-trends-report-2023\/\"><i><span style=\"font-weight: 400\">2023<\/span><\/i> <i><span style=\"font-weight: 400\">Legal Trends Report<\/span><\/i><\/a><span style=\"font-weight: 400\">, only 46% of consumers said they were open to working with law firms that used AI-powered software.<\/span><\/p>\n<p><span style=\"font-weight: 400\">For more information, insights, and trends around AI and law, be sure to take a look at our <\/span><a href=\"https:\/\/www.clio.com\/uk\/guides\/ai-guide-for-lawyers\/\"><span style=\"font-weight: 400\">AI guide for lawyers<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<h3><b>There\u2019s a growing financial risk for hourly billing<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Seventy-four per cent of billable work that\u2019s billed by the hour could be automated by generative AI. The types of work that have the highest automation potential include documenting and recording information, getting information, and analysing data or information\u2014all of which make up an average of 66% of the hourly work that the average law firm takes on.<\/span><\/p>\n<p><span style=\"font-weight: 400\">As a result, firm leaders may need to reconsider their <\/span><a href=\"https:\/\/www.clio.com\/uk\/blog\/law-firm-billing\/\"><span style=\"font-weight: 400\">billing frameworks<\/span><\/a><span style=\"font-weight: 400\">. If AI can reduce the time legal professionals spend on billable work, this would result in less revenue when billing by the hour. If charging based on fixed or flat rates, however, firms could have time to work more cases while still largely retaining what they charge for individual cases.<\/span><\/p>\n<h3><b>Fixed fee billing is growing<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Firms are billing 34% more of their cases on a fixed fee basis compared to 2016. Firms have also been charging 20% more for fixed fee cases since then. Since AI automation has the potential to reduce the value of hourly billable work, firms that shift to fixed-fee billing models stand to retain the value of their casework while opening up capacity to help more clients through greater efficiency. In fact, firms using AI are more likely to bill exclusively with fixed fees.<\/span><\/p>\n<h3><b>Clients prefer fixed-fee billing<\/b><\/h3>\n<p><span style=\"font-weight: 400\">As it turns out, offering fixed fees could also be helpful for client satisfaction. Seventy-one per cent of clients would prefer to pay a fixed fee for their entire case and 51% would prefer to pay a fixed fee for individual activities within their case. Still, hourly billing is the most common, with 71% of firms offering it to clients.<\/span><\/p>\n<h3><b>Fixed fee work gets billed out and paid faster<\/b><\/h3>\n<p><b>Legal professionals billing with fixed fees are nearly <\/b><b><i>twice as likely<\/i><\/b><b> as those billing hourly to collect payments almost immediately.<\/b><\/p>\n<p><a href=\"https:\/\/www.clio.com\/uk\/resources\/legal-trends\/\">\n\t\n\t\t\t\n\t\t\t\t\n\t\t\n\t\t\t\t\t\t\t\t\t\n\t\t\n\t\t\t\t\n\t\t\n\t\t\t\t\t\t\t\n\t\t\t\t\t\t\n\t\t\n\t\t\t\t\t\t\t\n\t\t\n\t\t\t\t\n\t\t\t\t\t\n\n<div\n\tclass=\"o-image l-image aligncenter wp-image-12408 size-full \"\n\t\tstyle=\"max-width: 46.1875rem;  width: 739px;\"\n\t\t>\n\t<div\n\t\tclass=\"o-image__wrap l-image__wrap js-lazy-image-wrapper\"\n\t\t\t\t\tstyle=\"padding-top:55.4803788904%;\"\n\t\t\t>\n\t\t\t\t\t<noscript>\n\t\t\t\t<img\n\t\t\t\t\ttitle=\"Fixed fee billing\"\n\t\t\t\t\talt=\"Chart&#x20;demonstrating&#x20;how&#x20;fast&#x20;billed&#x20;work&#x20;is&#x20;collected.\"\n\t\t\t\t\tsrc=\"https:\/\/www.clio.com\/uk\/wp-content\/uploads\/sites\/3\/2024\/10\/Screenshot-2024-10-24-at-12.12.22.png\"\n\t\t\t\t\twidth=\"739\"\n\t\t\t\t\theight=\"410\"\n\t\t\t\t\/>\n\t\t\t<\/noscript>\n\t\t\t\t<picture>\n\t\t\t\t\t\t<img\n\t\t\t\ttitle=\"Fixed fee billing\"\n\t\t\t\talt=\"Chart&#x20;demonstrating&#x20;how&#x20;fast&#x20;billed&#x20;work&#x20;is&#x20;collected.\"\n\t\t\t\twidth=\"739\"\n\t\t\t\theight=\"410\"\n\n\t\t\t\t\t\t\t\t\tloading=\"lazy\"\n\t\t\t\t\tdata-src=\"https:\/\/www.clio.com\/uk\/wp-content\/uploads\/sites\/3\/2024\/10\/Screenshot-2024-10-24-at-12.12.22.png\"\n\t\t\t\t\tsrc=\"data:image\/gif;base64,R0lGODlhAQABAIAAAP\/\/\/wAAACH5BAEAAAAALAAAAAABAAEAAAICRAEAOw==\"\n\t\t\t\t\tclass=\"is-lazy js-lazy-image\"\n\t\t\t\t\n\t\t\t\t\t\t\t\/>\n\t\t<\/picture>\n\t<\/div>\n\t<\/div>\n\n\t\t\t\n<\/a><\/p>\n<p><span style=\"font-weight: 400\">Firms aren\u2019t just billing and getting paid for fixed fee matters faster\u2014as it turns out, matters that are billed on an hourly basis take approximately <\/span><i><span style=\"font-weight: 400\">2.6 times longer<\/span><\/i><span style=\"font-weight: 400\"> to close compared to fixed fee matters.<\/span><\/p>\n<h3><b>More productive firms spend more on technology and marketing<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Since 2013, firms have increased their spending on software by an average of 20% each year\u2014at a greater pace than growth in revenue.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Based on recent data, <\/span><b>firms that invest more in software and <\/b><a href=\"https:\/\/www.clio.com\/uk\/blog\/marketing-your-law-firm\/\"><b>marketing<\/b><\/a><b> have utilisation rates above the industry average of 37%<\/b><span style=\"font-weight: 400\">\u2014which amounts to just under three hours of billable hours per day\u2014and they also earn much higher profit margins.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Firms with above-average productivity:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Spend 12% more on software<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Spend 41% more on marketing<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Earn 21% more in profitability<\/span><\/li>\n<\/ul>\n<h3><b>It\u2019s tough for potential clients to get in touch with a lawyer<\/b><\/h3>\n<p><span style=\"font-weight: 400\">We hired a third-party research company to conduct a secret shop for insight into the experience of finding a lawyer in 2024\u2014this was a follow-up of a similar study in 2019. The study involved emailing and phoning 500 law firms with a client inquiry.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Just 33% responded to our emails (less than the 40% in 2019)<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Only 40% of firms answered our phone calls (a significant drop from 56% in 2019). In total, 52% of firms either answered our phone calls or phoned us back, meaning 48% were essentially unreachable by phone.<\/span><\/li>\n<\/ul>\n<h3><b>Intake solutions can help improve client experience<\/b><\/h3>\n<p><span style=\"font-weight: 400\">To further support law firms in providing better client services, we looked at several technologies designed to enhance a firm\u2019s ability to respond to clients when they reach out\u2014and how these capabilities can improve key areas of business performance.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This year, we\u2019ve looked deeper into how certain capabilities within <\/span><a href=\"https:\/\/www.clio.com\/uk\/grow\/\"><span style=\"font-weight: 400\">Clio Grow<\/span><\/a><span style=\"font-weight: 400\"> can support law firms across several important business metrics, including:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Revenue generation<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Lead volume<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Time to hire<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Conversion<\/span><\/li>\n<\/ul>\n<p><b>We found that firms using these client-facing capabilities saw 51% more client leads\u2014meaning they were able to connect with more potential clients overall\u2014and 52% higher revenues.<\/b><\/p>\n<p><a href=\"https:\/\/www.clio.com\/uk\/resources\/legal-trends\/\">\n\t\n\t\t\t\n\t\t\t\t\n\t\t\n\t\t\t\t\t\t\t\t\t\n\t\t\n\t\t\t\t\n\t\t\n\t\t\t\t\t\t\t\n\t\t\t\t\t\t\n\t\t\n\t\t\t\t\t\t\t\n\t\t\n\t\t\t\t\n\t\t\t\t\t\n\n<div\n\tclass=\"o-image l-image aligncenter wp-image-12409 size-full \"\n\t\tstyle=\"max-width: 46.5625rem;  width: 745px;\"\n\t\t>\n\t<div\n\t\tclass=\"o-image__wrap l-image__wrap js-lazy-image-wrapper\"\n\t\t\t\t\tstyle=\"padding-top:56.1073825503%;\"\n\t\t\t>\n\t\t\t\t\t<noscript>\n\t\t\t\t<img\n\t\t\t\t\ttitle=\"Chart demonstrating improvements in client leads and revenue with technology.\"\n\t\t\t\t\talt=\"Chart&#x20;demonstrating&#x20;improvements&#x20;in&#x20;client&#x20;leads&#x20;and&#x20;revenue&#x20;with&#x20;technology.\"\n\t\t\t\t\tsrc=\"https:\/\/www.clio.com\/uk\/wp-content\/uploads\/sites\/3\/2024\/10\/Screenshot-2024-10-24-at-12.13.08.png\"\n\t\t\t\t\twidth=\"745\"\n\t\t\t\t\theight=\"418\"\n\t\t\t\t\/>\n\t\t\t<\/noscript>\n\t\t\t\t<picture>\n\t\t\t\t\t\t<img\n\t\t\t\ttitle=\"Chart demonstrating improvements in client leads and revenue with technology.\"\n\t\t\t\talt=\"Chart&#x20;demonstrating&#x20;improvements&#x20;in&#x20;client&#x20;leads&#x20;and&#x20;revenue&#x20;with&#x20;technology.\"\n\t\t\t\twidth=\"745\"\n\t\t\t\theight=\"418\"\n\n\t\t\t\t\t\t\t\t\tloading=\"lazy\"\n\t\t\t\t\tdata-src=\"https:\/\/www.clio.com\/uk\/wp-content\/uploads\/sites\/3\/2024\/10\/Screenshot-2024-10-24-at-12.13.08.png\"\n\t\t\t\t\tsrc=\"data:image\/gif;base64,R0lGODlhAQABAIAAAP\/\/\/wAAACH5BAEAAAAALAAAAAABAAEAAAICRAEAOw==\"\n\t\t\t\t\tclass=\"is-lazy js-lazy-image\"\n\t\t\t\t\n\t\t\t\t\t\t\t\/>\n\t\t<\/picture>\n\t<\/div>\n\t<\/div>\n\n\t\t\t\n<\/a><\/p>\n<h2><b>Where does the data come from?<\/b><\/h2>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/www.clio.com\/uk\/resources\/legal-trends\/\"><i><span style=\"font-weight: 400\">Legal Trends Report<\/span><\/i><\/a><span style=\"font-weight: 400\"> uses a range of methodological approaches and data sources to deliver the best insights about the state of legal practice and strategies for future growth.<\/span><\/p>\n<h3><b>Clio data<\/b><\/h3>\n<p><span style=\"font-weight: 400\">We\u2019ve analysed aggregated and anonymised data from tens of thousands of legal professionals in the U.S. This data provides important insights about how technology is currently being used by legal professionals, as well as its impact on firm performance.<\/span><\/p>\n<h3><b>Survey of legal professionals<\/b><\/h3>\n<p><span style=\"font-weight: 400\">We surveyed 1,028 U.S. legal professionals from June 5 to June 23, 2024. The legal professionals we surveyed included lawyers as well as support staff\u2014such as paralegals and administrators\u2014who are engaged in the management side of their practice.<\/span><\/p>\n<h3><b>Survey of the general population<\/b><\/h3>\n<p><span style=\"font-weight: 400\">We surveyed 1,003 adults in the U.S. general population from June 28 to July 2, 2024. This survey was designed to gauge attitudes, opinions, preferences, and behaviours regarding the legal profession among individuals who have hired lawyers in the past or who may become potential legal clients in the future. This sample is representative of the U.S. population by age, gender, region, income, and race\/ethnicity based on the most recent U.S. census statistics.<\/span><\/p>\n<h3><b>Automation analysis<\/b><\/h3>\n<p><span style=\"font-weight: 400\">We utilised an internally hosted large language model (LLM) to map Clio Manage work activities to activities in the Occupational Information Network (O*NET) Database that are applicable to the practice of law. We then used ChatGPT-4 to determine to what extent each O*NET work activity could be automated with AI. The LLM assigned an automation score between 0 (no potential for automation) and 100% (completely automatable) and provided a justification, which we used to evaluate and refine our study. From this analysis, we determined to what degree each type of work could be taken on by AI.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Next, we used a dataset of over 7 million time entries from anonymised and aggregated billing data from tens of thousands of lawyers and categorised them according to the standardised work activities provided in the O*NET Database. In doing so, we\u2019ve compared the automation potential for certain types of work with respect to how much that work contributes to firm revenues in the form of hourly work.<\/span><\/p>\n<h3><b>Law firm financial statements<\/b><\/h3>\n<p><span style=\"font-weight: 400\">We partnered with a Clio-Certified Consultant,<\/span><a href=\"https:\/\/cpn-legal.com\/\"> <span style=\"font-weight: 400\">CPN Legal<\/span><\/a><span style=\"font-weight: 400\">, to source historical, anonymised profit and loss reports and balance statements from 122 law firms. The historical statements cover decades of law firm finances from sole practitioners, small, and medium-sized law firms.<\/span><\/p>\n<h3><b>Secret shop<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Clio partnered with market research agency Lux to conduct the Secret Shopping study, which aimed to evaluate law firm performance on digital and traditional channels.
