Initial e-filing procedure

Before filing, check the Denton County court website for any standing orders or local rules that may affect your filings. This section outlines the procedure for the initial electronic filing of a new case in Denton County.

  1. Select an EFSP: Access a state-approved Electronic Filing Service Provider (EFSP) website and create an account. A list of approved EFSPs is available on eFileTexas.gov.
  2. Prepare documents:
    • Convert all documents to a text-searchable PDF format, adhering to Statewide E-Filing Rules [Texas Rules of Judicial Administration, Rule 9] and JCIT standards (e.g., 8.5 x 11 inch page size, specified DPI).
    • Attachments: Attach supporting documents (affidavits, exhibits, etc.) as separate PDF files.
    • Name: Use clear, concise alphanumeric filenames (under 50 characters, including the extension).
    • Redaction: Redact confidential information according to the relevant Texas Rules of Procedure [Texas Rules of Civil Procedure, Rule 76a(8); Texas Rules of Appellate Procedure, Rule 9.1(k)].
  3. Initiate filing: Log in to your chosen EFSP and select the correct Denton County court, indicating you are starting a new civil or criminal case.
    • Enter case details and upload: Complete all required fields in the EFSP, including party details and case type. Upload your prepared PDF documents, designating lead documents and attachments.
  4. Specify service: Indicate how other parties will be served, following the rules of procedure for your case type [Texas Rules of Civil Procedure, Rule 21a]. E-service is common for attorneys and e-filing participants; traditional service is needed for others.
  5. Pay fees and confirm: Review the applicable fee schedule on the Denton County Clerk’s website or through the EFSP. Submit payment electronically and retain the confirmation or receipt.
Post-filing considerations
  • Original documents: You may need to physically file original documents with the Clerk within a specific timeframe after e-filing the application, as outlined in the relevant rules (e.g., original wills in probate).
  • Technical issues: If you experience technical issues during the e-filing process that prevent timely submission, document the issue (e.g., screenshots, error messages) and promptly contact the Denton County Clerk’s Office for guidance.
  • Rejection: If the clerk rejects your initial filing, carefully review the electronic notification for the specific reasons for rejection. Correct the identified errors and resubmit the filing through the EFSP by the provided deadline.
General e-filing procedures
  • Mandatory e-filing: E-filing is mandatory for civil and criminal filings by attorneys. Non-attorney filers are encouraged to e-file.
  • Subsequent filings: To make a filing after the initial case, log in to your EFSP, select your case, prepare and upload your document with the correct filing type, ensure service on all parties, pay any necessary fees, and submit. Keep your confirmation and monitor for court updates.
  • Lead documents: The main document you are filing should be marked as the lead document in the EFSP, and any supporting documents should be attached separately.
