What does verification mean in the world of legal AI?
Verifying AI results means checking outputs for accuracy, completeness, and appropriateness. To be usable, an AI output must meet all three criteria—a deficiency in any one can render it unusable. For lawyers, verification is both a best practice and a professional responsibility under ABA Model Rule 1.1. ABA Formal Opinion 512 builds on this, calling for “an appropriate degree of independent verification” when reviewing AI outputs. And under Model Rules 5.1 and 5.3, lawyers are already responsible for supervising the work of colleagues and staff. Supervising AI output is an extension of that same obligation, not a new one. Do I have to validate the AI system’s output?
In professional legal work, validation is both a best practice and a professional responsibility, akin to reviewing the work of an associate attorney or support staff. Verification ensures that you have a work product that will serve its purpose, whether that’s intake, marketing, or legal research and drafting.
Three AI output shortcomings to look out for
When verifying AI outputs, look for three shortcomings, each undermining a different quality criterion.
- Hallucinations are made-up content—including invented facts, cases, citations, and even legal tests—that undermine accuracy. Because AI-generated text is often well-written and confident, AIs can make these invented ideas seem credible and legitimate.
- Omissions are equally concerning and often easier to miss. These gaps, which prevent completeness, include missing elements of a legal rule, skipped steps despite explicit prompting, and gaps in intake notes or discovery summaries.
- Misfit occurs when you get content that may be accurate and even complete but isn’t appropriate for your purpose. For example, if you ask AI to summarize significant recent tort decisions in the Ninth Circuit, and it instead gives you California state court decisions, that would not fulfill your request. Outputs with the wrong tone, format, or assumptions fall into the same category.
Verifying AI results with the Legal QC checklist

- Completeness check: This step involves looking for omissions, such as missing information or missed steps.
- Consistency check: This verification step helps ensure quality, with human reviewers verifying that AI consistently used defined terms, dates, parties, and other facts.
- Rewrite pass: The checklist’s final step is adjusting the content to match your voice, tone, strategy, and professional judgment.

How to make AI verification faster over time

For example, better prompts produce better outputs, which makes verification faster. One prompt best practice is requesting that the output cites a source for each proposition or idea. A prompt for summarizing a trial record, for instance, should require citations to the record.
